The Committee on Political Subdivisions moved to amend the bill on page 6, section 27, subsection (f) lines 54 through 63 by striking those lines and inserting,

 

(f) After an outdoor refreshment area has been approved, any qualified permit holder who

is eligible to participate in the outdoor refreshment area shall submit a map or survey of the outdoor refreshment area to the Commissioner, demonstrate compliance with all applicable requirements under §60-1-1 et seq. and §11-16-1 et seq. of this code, and pay a $1,000.00 licensing fee to the Commissioner which pays for the first year of outdoor refreshment area designation. If approved, the Commissioner shall issue an outdoor refreshment area designation to the qualified permit holder.  Any permit holder that receives such a designation shall comply with all laws and rules that govern its license type, and the applicable public health and safety requirements established for the area under subsection (g) of this section and the legislative act of the municipality establishing the designated outdoor refreshment area.  Each qualified permit holder receiving such a designation may serve alcohol or nonintoxicating beer to patrons, as permitted by the qualified permit holder’s license issued by the Commissioner.   

To maintain outdoor refreshment area designation a $1,000 annual fee, paid to the

Commissioner, is required.   This payment is due on July 1.
